Which county handles your case

Illinois venue law (750 ILCS 5/104) says a divorce is heard in the county where either spouse lives. Most of Loves Park, and all of Machesney Park, is in Winnebago County. Census Bureau boundary maps show a small area on the city’s east side in Boone County.

Not sure which county you live in? Your property tax bill or voter registration card shows it. If you live in the Boone County part of Loves Park and your spouse lives in Winnebago County, you can file in either one. If both of you live in Boone County, see our Belvidere divorce guide.

Your courthouse and Circuit Clerk

The usual State Street entrance has been closed since May 2025 while Winnebago County builds a new Family Court Center. The temporary door at 403 Elm Street is one block south, across from the County Administration Building. Leave extra time for security.

Filing costs and fee waivers

The Winnebago County Circuit Clerk’s fee schedule effective September 9, 2026 lists:

  • $347 for a petition for dissolution of marriage, with or without children (the same amount applies to legal separation);
  • $222 for the other spouse’s appearance;
  • $36 per year for the child support and maintenance service fee in cases with children.

Optional sheriff service of the summons costs extra. Fees change during the year, so confirm on the Clerk’s fee page before paying.

The Illinois Application for Waiver of Court Fees can eliminate or reduce these costs. A full waiver is available if you receive SNAP, SSI, TANF, AABD or General Assistance, if your income is at or below 125% of the federal poverty level, or if paying would cause substantial hardship. Income up to 200% of the poverty level can qualify for a partial waiver. Keep a copy of the granted order: it can also cover court-ordered mediation and parenting programs.

Doing more of it from home

For Loves Park and Machesney Park residents, a lot of the process can happen without a trip downtown:

  1. E-file. Documents go through eFileIL via an approved service provider. You register and set up payment first.
  2. Skip formal service if you agree. According to the 17th Circuit’s divorce guide, if your spouse signs a notarized Waiver and Consent, the papers do not need to be served and you propose the court date when filing. With a summons instead, the guide says the first court date is typically about 6 months out.
  3. Take the parenting class online. With minor children, both parents must finish a circuit-approved program within 90 days of filing or service (Family Division General Order 4.05). The PACT course, Parenting from Two Homes, runs 4 hours online for $75 and is free for Winnebago parents with an approved fee waiver. General Order 4.05 says online programs need court approval, so confirm before enrolling.
  4. Appear on Zoom. Many family hearings in the circuit are virtual. Under General Order 4.08, exhibits and prove-up documents go in by eFileIL no later than 4:30 p.m. three business days before the hearing.
  5. Ask a navigator by email. The circuit’s “Ask the Court Navigator” service answers questions about forms and procedure during business hours.

If you and your spouse disagree about the children, Local Rule 14.08 generally requires mediation before a contested hearing. Mediators are paid by the parties, at $100 an hour for an appointed mediator when both of you have fee waivers (General Order 4.07). A case can be found ineligible for mediation where there is domestic violence. For urgent safety issues, see our guide to emergency custody orders.

Vetting a divorce lawyer

Hiring a lawyer is optional in Illinois. If your case has children, real estate, retirement accounts, a business or a maintenance claim, a family law attorney can advise you on what is at stake. Use the first consultation to interview them:

  • Is the lawyer licensed and free of public discipline? Check the Illinois ARDC lawyer search before the meeting, not after.
  • How many divorce cases do they handle in Winnebago County, and do they regularly use the circuit’s mediation program?
  • Do they bill hourly against a retainer, offer a flat fee for defined tasks, or take limited scope work (for example, only reviewing your settlement)?

Whatever the fee model, Illinois law protects you. Under 750 ILCS 5/508(f), a written divorce engagement agreement must have appended to it the Statement of Client’s Rights and Responsibilities. It says a lawyer “may not require a non-refundable retainer fee” and must give back any overpayment, that you are entitled to itemized bills at least quarterly, that fees cannot be contingent on getting the divorce or on the amount of support or property awarded, that pledging assets to secure fees requires court approval, and that your file goes to your new counsel within 30 days if you change lawyers.

Illinois basics

  • Residency: at least one spouse must have lived in Illinois for 90 days (750 ILCS 5/401).
  • Grounds: irreconcilable differences only. Six continuous months living apart creates an irrebuttable presumption.
  • Child support: run the numbers with our Rockford-area child support calculator and see the Illinois child support guide.
  • Maintenance: estimate it with the Illinois alimony calculator.
  • Served? You usually have 30 days to respond. Read served with divorce papers in Illinois.
  • Joint Simplified Dissolution: available only if you meet every condition in 750 ILCS 5/452, including no shared children, a marriage of 8 years or less, no real estate, IRAs under $10,000 combined as the only retirement assets, a mutual waiver of maintenance, net marital property under $50,000, combined income under $60,000 with neither spouse over $30,000, and signed written agreements splitting your property and debts and deciding who keeps any companion animals. Both spouses appear in person.
